Agreement to Terms

Welcome to The Collective Whiteboard. By purchasing a showcase slot or using our services, you agree to be bound by these Terms of Service. Please read them carefully.

These Terms of Service ("Terms") constitute a binding agreement between you ("Agent," "you") and The Collective Whiteboard ("The Collective," "we," "us"). By claiming a lot, joining the waitlist, or otherwise using the platform at collectivewhiteboard.com, you accept these Terms in full. If you do not agree, do not use the service.

Eligibility

The Collective is a promotional surface available exclusively to actively licensed real estate professionals in the United States. By claiming a lot you represent and warrant that:

  • You hold an active real estate license in good standing.
  • You hold an active, exclusive listing agreement for the property being promoted.
  • You have secured all necessary seller permissions for national media placement.
  • You are in full compliance with your local MLS advertising guidelines and applicable Fair Housing laws.

The Slot Rules

The board is a finite, curated surface. All claims are governed by the following non-negotiable structural rules:

  • Finite Grid — The board is permanently capped at 24 (twenty-four) national lots. No exceptions, no expansions, no premium tiers.
  • 168-Hour Window — Each claimed lot goes live upon stamp and remains published for exactly 168 hours (7 days). At expiration, the lot is released back to the pool.
  • Flat Acquisition Fee — A single lot is $300 USD, flat. No renewals, no upsells, no hidden fees.
  • One Property, One Lot — Each lot represents one active listing. Bundling multiple addresses into a single lot is prohibited.
  • Direct Contact — All inbound inquiries route directly to the listing agent (and co-listing agent, if provided). We do not lease, sell, or redistribute your leads.
  • Content Standards — Hero images must depict the actual property. Stock imagery, unrelated visuals, or misleading representations will be removed without refund.
  • Compliance Receipt — Every claim requires an affirmative compliance certification, which is timestamped and permanently logged as a legal receipt.

Refund Policy

⚠️ Strict No-Refunds Policy

All slot placement purchases on The Collective Whiteboard are 100% final, non-refundable, and non-transferable. Once a slot transaction is processed, the digital canvas space is instantly allocated to you, and no refunds or credits will be issued under any circumstances, including but not limited to agent scheduling changes, listing cancellations, or user error.

Because each lot occupies a finite, time-locked position on a capped-24 board, a claim removes that inventory from every other agent in the country for the full 168-hour window. Exceptions are considered solely at our discretion in the event of verified platform-side technical failure preventing your lot from being published. Requests must be submitted within 48 hours of the original claim to support@collectivewhiteboard.com.

Definition of a Valid "Slot"

A digital showcase placement is considered a Valid Slot only when it meets all of the following technical and operational criteria:

  • The slot has been fully paid for via our verified payment processing gateway ($300 placement fee).
  • The slot displays active, non-expired data within its designated structural boundaries on the main public canvas.
  • The content uploaded contains legitimate real estate listings, agent branding, or approved promotions that strictly comply with our community guidelines.
  • The countdown timer or active duration period associated with that specific slot ID has not expired.

Waitlist & First Right of Refusal

Joining the waitlist is free and grants chronological priority. When a lot expires, the agent at the top of the queue receives an exclusive 30-minute window to claim the released lot at the then-current price. If the priority agent passes or does not act within the window, the lot opens to public "Buy It Now" acquisition at the current decaying price, first-payment-wins.

Intellectual Property

You retain ownership of the listing content, imagery, and contact information you submit. You grant The Collective a limited, worldwide, royalty-free license to display, cache, and syndicate that content solely for the purpose of operating the promotional surface during your 168-hour window and the historical archive thereafter. The Collective branding, layout, editorial framework, and codebase remain our exclusive property.

Prohibited Conduct

  • Impersonating another agent, brokerage, or seller.
  • Submitting listings you do not personally and exclusively represent.
  • Scraping, mirroring, or reselling board data or archive content.
  • Interfering with the auction, waitlist, or priority-offer mechanics.
  • Uploading unlawful, discriminatory, or deceptive content.

Violation results in immediate lot removal, permanent account suspension, and forfeiture of the acquisition fee.

Disclaimers

The Collective is a promotional surface, not a broker, agent, MLS, or transactional platform. We do not verify property details, ownership, or listing agreement authenticity beyond the compliance certification submitted at claim. The service is provided "as is" without warranties of any kind, express or implied.

Limitation of Liability & User-Generated Content Error

The Collective Whiteboard operates as an automated self-service digital canvas platform.

  • Agent Data Entry Responsibility — You, the agent, assume 100% sole responsibility for the accuracy, spelling, formatting, links, phone numbers, image resolutions, and notes entered into your slot configuration form.
  • No Liability for Input Failures — The Collective Whiteboard, its parent company The Collective Software Group, LLC, and its developers are not liable for any visual errors, listing display failures, broken links, typos, missed leads, or financial damages resulting from information improperly filled out or submitted by the agent.
  • Technical Uptime — While we strive for 100% platform uptime, we are not liable for temporary, unpredictable internet hosting or server disruptions beyond our reasonable control.

To the fullest extent permitted by law, The Collective's aggregate liability for any claim arising out of or related to the service is limited to the fees you paid to us in the twelve (12) months preceding the claim. We are not liable for indirect, incidental, consequential, or special damages, including lost commissions, lost leads, or lost goodwill.

Termination

We may suspend or terminate access for material breach, non-payment, suspected fraud, or repeated violations of these Terms. Upon termination, active lots may be removed without refund.

Governing Law

These Terms are governed by the laws of the United States and the state in which The Collective is domiciled, without regard to conflict-of-laws principles. Disputes shall be resolved exclusively in the state or federal courts of that jurisdiction.

Changes to These Terms

We may update these Terms from time to time. Material changes will be posted on this page with a revised "Last Updated" date. Continued use of the service after changes take effect constitutes acceptance.
